Privacy Policy

This policy explains what personal information we collect, why we collect it, how we look after it, and what happens to the data on a device you send us for recovery. It applies to kiwidatarecovery.co.nz and to our data recovery services.

Who we are

Kiwi Data Recovery is a specialist data recovery lab based at 213 Dominion Road, Mount Eden, Auckland 1024, New Zealand. In this policy, "we", "us" and "our" refer to Kiwi Data Recovery.

We are committed to protecting your privacy and handling your information in accordance with the Privacy Act 2020 and its information privacy principles.

Information we collect

We collect personal information that you give us, and a limited amount of technical information collected automatically when you use our website.

Information you give us when you contact us, book a job or send in a device:

  • Your name, email address, phone number and, where relevant, your business name
  • Your address or return delivery address
  • Details of your device: make, model, serial number and its fault history
  • What happened to the device and what you are trying to recover
  • Payment information necessary to process a transaction

Information collected automatically when you visit our website:

  • Your IP address, browser type and device type
  • Pages visited, time spent and the site or search that referred you
  • Information collected by cookies (see Cookies below)

We do not collect more information than we need, and we do not require you to provide personal information beyond what a recovery job or enquiry actually requires.

Data on devices you send us

This section matters more than any other, so we state it plainly.

When you send us a device, the data on it may include your personal information, and often the personal information of other people - your photos, messages, business records, client files and correspondence. We treat all of it as confidential.

  • We access your data only as far as the recovery requires. Assessment and recovery involve reading storage and verifying that recovered files open correctly. We do not browse, copy, share or use your data for any other purpose.
  • Work is done in-house. Your device is worked on by our own specialists in our Auckland lab. We do not send devices offshore and we do not subcontract recovery work.
  • Recovered data is returned to you, then erased. Once you confirm you have received your recovered data, the working copies held in our systems are securely erased. If you would like your copy retained for a period as a safety net, tell us and we will agree that with you in writing.
  • Confidentiality agreements. Where your situation requires it - commercially sensitive, legal or health information, for example - we are willing to sign a non-disclosure agreement before work begins.
  • Unlawful material. We may be required by law to report material that is objectionable or unlawful under New Zealand law if we encounter it in the course of recovery. This is a legal obligation, not a discretionary practice.

How we use your information

We use your personal information to:

  • Respond to your enquiry and give you advice about your situation
  • Assess your device, prepare a quote and carry out approved recovery work
  • Return your device and recovered data to you
  • Take payment and keep the business records we are legally required to keep
  • Contact you about a job in progress
  • Improve our website and our services

We do not sell your personal information, and we do not trade or rent contact details to anyone.

Who we share information with

We share personal information only where it is necessary, and only with:

  • Courier and delivery providers, to send your device and data back to you
  • Payment processors and our bank, to take payment
  • Our accountants and professional advisers, where required
  • Suppliers of parts, where sourcing a donor part requires device model details (never your data)
  • Law enforcement or other authorities, where we are required to do so by law

We do not give anyone else access to the data on your device.

Storage, security and retention

Personal information is stored securely, and access is limited to the people who need it to do their work. Devices in our care are logged, labelled and stored securely from the moment they arrive.

We keep contact and job records for as long as we need them for the job, our legal obligations and any warranty or dispute period. Working copies of recovered data are securely erased once you confirm receipt, unless we have agreed otherwise with you in writing.

If you have not collected a device or responded to us about a completed or declined job, we will contact you at the details you gave us before making any decision about the device. Uncollected devices are dealt with under our terms and conditions.

Cookies and website analytics

Our website may use cookies and similar technologies to make the site work properly and to understand how it is used - which pages people read, and how they arrived. This information is used in aggregate to improve the site.

You can set your browser to refuse cookies or to alert you when cookies are being sent. Some parts of the site may not work as intended if you do.

Marketing and communications

We will contact you about a job you have with us. We will only send you marketing communications if you have asked for them, and every marketing message we send includes a way to unsubscribe.

If you would prefer not to hear from us other than about your job, tell us and we will note it.

Your rights

Under the Privacy Act 2020 you have the right to:

  • Ask what personal information we hold about you
  • Ask us to correct information that is wrong
  • Ask us to delete information where we are not required to keep it
  • Withdraw consent to marketing at any time
  • Complain if you believe we have mishandled your information

If you are not satisfied with our response, you can complain to the Office of the Privacy Commissioner at privacy.org.nz.

Changes to this policy

We may update this policy from time to time. The version on this page is always the current one, and the date at the top shows when it was last changed.
